Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") governs your use of the Iris AI voice receptionist service operated by DotFun, LLC ("Company," "we," "us," or "our"). This AUP is incorporated into and forms part of our Terms of Service.

The purpose of this policy is to ensure that the Service is used responsibly, ethically, and in compliance with all applicable laws. Violations of this AUP may result in suspension or termination of your account and may trigger indemnification obligations under the Terms of Service.

2. User Representations & Warranties

By using the Service, you represent and warrant that:

  • You are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into binding agreements

  • If you are using the Service on behalf of an organization, you have the authority to bind that organization to this AUP and the Terms of Service

  • You will comply with all applicable federal, state, local, and international laws and regulations in connection with your use of the Service

  • You have obtained all necessary licenses, permits, and authorizations required for your intended use of the Service, including any industry-specific regulatory requirements

  • You understand that the Service uses artificial intelligence, which may produce inaccurate or unexpected outputs, and you accept responsibility for monitoring and correcting such outputs as described in the Terms of Service

3. Deceptive Practices Prohibited

You may not use the Service to engage in deceptive practices, including but not limited to:

  • Impersonation: Configuring the AI to impersonate specific individuals (celebrities, public figures, or private persons) without their consent

  • False Identity: Representing that a human is answering calls when only the AI is, or vice versa

  • Misleading Claims: Making false or misleading claims about your business, products, services, or credentials through the AI

  • AI Disclosure: Attempting to hide, remove, or circumvent the AI disclosure provided to callers. Callers must be clearly informed at the beginning of each interaction that they are communicating with an AI agent, not a human. This disclosure must occur before any substantive information is collected from the caller.

  • Fraudulent Schemes: Using the AI to conduct phishing, social engineering, or other fraud schemes

4. Illegal Activities Prohibited

You may not use the Service for any illegal purpose, including but not limited to:

  • Fraud: Conducting wire fraud, securities fraud, insurance fraud, or any other fraudulent activity

  • Scams: Operating pyramid schemes, Ponzi schemes, advance-fee fraud, or similar scams

  • Harassment: Harassing, threatening, stalking, or intimidating any person

  • Discrimination: Engaging in discriminatory practices based on race, color, religion, sex, national origin, age, disability, or other protected characteristics

  • Money Laundering: Using the Service to facilitate money laundering or terrorist financing

  • Illegal Goods/Services: Promoting or facilitating the sale of illegal drugs, controlled substances, weapons, or other prohibited items

5. Telecommunications Compliance

You must comply with all applicable telecommunications laws and regulations governing voice calls and text messages (SMS/MMS):

  • TCPA Compliance: The Telephone Consumer Protection Act prohibits certain automated calls and text messages and requires specific disclosures and consent. You are responsible for ensuring your use of both voice and SMS features complies with TCPA, including obtaining prior express written consent where required.

  • Do-Not-Call Compliance: You must maintain and honor Do-Not-Call requests and comply with the National Do-Not-Call Registry requirements

  • Caller ID Accuracy: You may not spoof or falsify caller ID information in violation of the Truth in Caller ID Act

  • Robocall Restrictions: You may not use the Service to make illegal robocalls, including unsolicited telemarketing calls without prior express written consent

  • SMS Compliance: All text messages sent through the Service must comply with applicable laws, carrier guidelines, and industry standards, including the CTIA Messaging Principles and Best Practices. You must obtain proper opt-in consent before sending text messages and honor all opt-out requests immediately.

  • Recording Consent: The Service records and transcribes calls as part of its core functionality. You are solely responsible for ensuring compliance with all applicable call recording laws in your jurisdiction and the jurisdiction of your callers, including two-party (all-party) consent requirements in states such as California, Florida, Illinois, Pennsylvania, and others. You must configure your AI agent to provide clear recording disclosure at the beginning of each call where required by law.

6. Content Restrictions

You may not configure the AI or provide content that includes:

  • Hate Speech: Content that promotes hatred, violence, or discrimination against individuals or groups based on protected characteristics

  • Adult Content: Sexually explicit content, pornography, or obscene material

  • Violence: Content that promotes or glorifies violence, self-harm, or terrorism

  • Child Safety: Any content that exploits or endangers minors

  • Defamatory Content: False statements that damage the reputation of individuals or organizations

  • Copyrighted Material: Content that infringes on intellectual property rights without authorization

7. Data Responsibility & Privacy

You are responsible for the data you provide to and collect through the Service:

  • Uploaded Content & Knowledge Base: You represent and warrant that you own or have all necessary rights to any content you upload to the Service or provide for knowledge base creation, including documents, website content, and business information. You must not upload content that contains third-party intellectual property without authorization or that violates any person's rights.

  • Caller Data & Personal Information: The Service collects information from callers on your behalf, including names, phone numbers, and any details shared during conversations. You are the data controller for this information and are solely responsible for complying with all applicable privacy and data protection laws, including the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR) where applicable, and any other relevant federal, state, or international privacy regulations.

  • Sensitive Data: You must not configure the AI to solicit or collect sensitive personal information — including Social Security numbers, financial account numbers, health information protected under HIPAA, or payment card data subject to PCI DSS — unless you have implemented appropriate legal, technical, and organizational safeguards and have a lawful basis for doing so.

  • Data Subject Rights: You must maintain processes to respond to data subject requests (access, deletion, correction) related to personal information collected through the Service, in compliance with applicable law.

  • Website Scraping: When you direct the Service to scrape your website for knowledge base creation, you represent that you have the authority to do so and that the scraped content does not infringe on any third-party rights. You must not direct the Service to scrape websites you do not own or have authorization to use.

8. Technical Abuse

You may not engage in technical abuse of the Service, including:

  • Reverse Engineering: Attempting to reverse engineer, decompile, or extract the source code of the AI models or Service

  • Bypassing Limits: Attempting to circumvent usage limits, rate limits, or other technical restrictions

  • Unauthorized Access: Attempting to access accounts, systems, or data that you are not authorized to access

  • Service Disruption: Actions that could disrupt, degrade, or impair the Service for other users

  • Data Scraping: Automated scraping or extraction of data from the Service beyond your own account data

  • Security Testing: Performing security testing, penetration testing, or vulnerability scanning without prior written authorization

  • Prompt Manipulation: Injecting malicious instructions, adversarial prompts, or hidden commands into business data fields (such as company name, service descriptions, pricing, or custom instructions) with the intent to manipulate the AI's behavior beyond its intended functionality, override safety controls, or cause it to act outside the scope of your configured use case

9. Third-Party Integrations

The Service integrates with third-party platforms (including but not limited to Google Calendar, CRM systems, and communication providers). When using these integrations:

  • Compliance with Third-Party Terms: You must comply with the terms of service and acceptable use policies of all third-party services connected to your Iris account. Violations of third-party terms that affect the Service may be treated as violations of this AUP.

  • Access Controls: You are responsible for maintaining appropriate access controls, permissions, and security settings for all third-party accounts connected to the Service. We are not liable for unauthorized access resulting from misconfigured third-party integrations.

  • Data Sharing: You acknowledge that enabling integrations may involve sharing data between the Service and third-party platforms. You are responsible for ensuring that any such data sharing complies with applicable privacy laws and your obligations to your callers and customers.

10. Professional Advice Limitations

The AI receptionist is not a substitute for professional advice. You must not configure or use the AI to:

  • Legal Advice: Provide legal advice or legal opinions (unless you are a licensed attorney using it within appropriate ethical boundaries)

  • Medical Advice: Diagnose medical conditions, recommend treatments, or provide medical advice (unless you are a licensed healthcare provider with appropriate disclaimers)

  • Financial Advice: Provide investment advice, tax advice, or specific financial recommendations without appropriate licensing and disclaimers

  • Emergency Services: Replace or interfere with emergency services. Callers with emergencies should be directed to call 911

If your business operates in a regulated industry, you are responsible for ensuring appropriate disclaimers and limitations are in place.

11. Modifications to This Policy

We reserve the right to modify this AUP at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, for significant changes, by sending notice via email or in-app notification at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated AUP. If you do not agree with the modifications, you must stop using the Service and cancel your subscription in accordance with the Terms of Service.

12. Liability & Indemnification

Violations of this AUP may expose you to significant legal and financial liability. Without limiting the generality of the Terms of Service:

  • Indemnification: Your indemnification obligations under Section 14 of the Terms of Service expressly apply to all claims, damages, losses, and expenses arising from your violation of this AUP, including claims by callers, regulatory authorities, or other third parties.

  • Limitation of Liability: DotFun, LLC and its members, managers, officers, directors, employees, contractors, and agents (the "DotFun Parties") shall not be liable for any damages arising from your violation of this AUP or the consequences thereof, as further described in Section 13 of the Terms of Service.

  • Regulatory Consequences: You acknowledge that violations of telecommunications laws, data protection regulations, and other applicable laws referenced in this AUP may result in significant fines, penalties, and legal actions by government authorities. DotFun bears no responsibility for such consequences.

13. Enforcement

Monitoring: We may monitor use of the Service for compliance with this AUP. However, we are not obligated to monitor and are not responsible for content transmitted through the Service.

Violation Response: If we determine that you have violated this AUP, we may take any of the following actions at our sole discretion:

  • Issue a warning

  • Temporarily suspend your account

  • Permanently terminate your account

  • Remove or disable access to violating content

  • Report violations to law enforcement authorities

Reporting Violations: If you become aware of any violation of this AUP, please report it to connect@dotfun.co. We will investigate reports and take appropriate action.

No Liability: We shall not be liable for any action taken to enforce this AUP, including account suspension or termination.

14. Severability

If any provision of this AUP is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
